1. INTRODUCTION

These Terms outline the rights and responsibilities when using our services. By accepting a quote, signing digitally or paying a deposit, you agree to these Terms. We may update these Terms and changes will be posted on our website and apply to new projects.

2. SERVICE AND PROCESS

We provide video biographies including interviews and editing.

  • Filming will be at a location of your choice with any required permissions and fees arranged by you.

  • Please send photos and any additional materials within 2 weeks after the filming date.

  • We will record and edit the footage and provide a draft edit 4-6 weeks after the shoot.

  • Please return edit tweaks or revisions within 14 days of receiving the draft.

  • One round of reasonable edit tweaks is included. Further changes and major changes or re-shoots may incur additional costs.

3. PURPOSE AND USE

  • Unless we agree otherwise in writing, the Film is supplied as a private family recording for personal viewing.

  • You agree not to upload, screen, post or distribute the Film publicly without our prior written consent.

  • If you want a version for broader sharing, we may produce an alternative shareable cut with sensitive content removed or anonymised. Extra editing fees may apply.

4. CLIENT STATEMENTS, MATERIALS AND CONSENTS

  • You are responsible for all statements made in your interview and for all materials you provide.

  • You warrant that factual statements about other people are true and not misleading and that your materials do not breach confidence, privacy or intellectual property.

  • Where reasonable, you will obtain consent from any identifiable third parties whose personal information you supply.

  • You agree to provide documents or other support for serious factual claims if requested.

5. DISTRIBUTION AND ACCESS CONTROLS

  • Drafts are supplied by password-protected link. Downloads are disabled by default for drafts.

  • Final delivery is by USB and a password-protected link. We may disable an online link if a legal concern arises.

  • You are responsible for how you share the Film after delivery and you agree to keep the Film private unless we have approved public use in writing.

6. CREDITS AND BRANDING

  • For private family recordings the end credit will be neutral, for example:

    “Produced as a private family recording for [Client Name] by All About Me Films.”

  • Promotional stings or logo animations are used only on public or portfolio versions with your consent.

  • We may request to use short clips or stills for our portfolio or website but will only do so with your written approval.

7. PAYMENTS AND CANCELLATION

  • A deposit is required on quote acceptance. The balance is due on the shoot date.

  • Cancellation terms:

    • 4 to 2 weeks before the project: 50% deposit refund.

    • 14 days or less before the project: no deposit refund.

    • If you postpone within the cancellation window then later cancel, the original cancellation terms still apply.

    • A second postponement will forfeit your deposit unless you provide a medical certificate.

8. MATERIALS AND DATA

  • We will take reasonable care of your materials but storage is at your risk. We are not liable for loss or damage to originals.

  • Raw footage is retained for 12 months unless agreed otherwise.

  • Fees apply for copies or transfers of footage or project files.

9. INTELLECTUAL PROPERTY AND LICENSING

  • We retain copyright in the footage, edit and project files until full payment is received.

  • After full payment you own the finished Film for private family viewing. You also receive a non-exclusive licence to use stills or short clips from the Film for private purposes.

  • Public distribution including posting online, public screening or paid use requires our prior written consent even after full payment, so we can manage legal and rights risks.

10. DELAYS AND FAILURE TO DELIVER

  • We are not liable for delays caused by factors outside our control or by late client materials or communication.

  • If equipment failure or unforeseen events prevent delivery, our liability is limited to refunding amounts paid for undelivered services.

11. LIABILITY AND INDEMNITY

  • You acknowledge that the Film records personal recollections. We do not verify every statement.

  • You indemnify All About Me Films against claims, costs and losses arising from your statements or materials in the Film including defamation, breach of confidence and privacy.

  • To the extent permitted by law, our total liability is limited to the amount paid for the project. We are not liable for indirect or consequential loss, either to you or any third party.

12. GENERAL

  • You agree to comply with these Terms. If any clause is unenforceable the rest remain in effect.

  • These Terms are governed by the laws of Victoria, Australia and the parties submit to the courts of Victoria.
